CD's and such are pressed months ahead of the release date. It is not inconceivable that some were signed in December or early January before David passed. I wouldn't buy it without some bullet proof provenance however.

Aren't you confusing this with "Blackstar"?

Bowie had a few years to sign "The Next Day". It was released in March 2013 from memory.

Which is the date he's signed on the cd by the looks of it! - could still be a fake though, would need more serious comparison with known genuine autographs from that era - the deluxe bound books spring to mind.

IIRC There was a contest to win this on the Bowie website. I specifically remember entering my name somewhere online for a signed The Next Day CD in 2013, though it may not be this exact copy.
