20yrs of using my images on a Bowie web site without my permission.

We'll see how it goes.

I'm supremely confident.

It's principle not cash and I never give in.

I heard that there is gonna be a massive copyright clampdown.
I really hope they don't fuck up the whole boot thing though, it is an oasis in a desert of commercial crap.

It's good that there is copyrights.
but it's a little strange for me that we want copyrights for a photo and on the othersite we we download or buy bootlegs.

If it is about the principle you should reach out to the user who is using your pictures without your consent. They likely have never considered that they are doing harm to anybody by offering reference based information or sharing of bootlegs. Copyright is right and proper but often does not do enough to protect artists. In this instance you will likely see a better result by reaching out.

But all the same you should at least receive credit for the art you produce and share. There is never really a positive outcome in these things as courts see it a small change and lawyers make a fortune at the expense of everybody else.

Your art matters and fans seeing it is important of course. Nice if your name is attached to it too.

I'm on the other side of this question. I'm a professional artist, and my paintings and prints have shown up all over the place (without permission). Websites, boot covers, books.

I've never bothered to sue anyone, though I have contacted a few people and asked that they add proper attribution. They usually do.

I can't understand why anyone, such as a photographer, would sue over his image being used for a boot cover or on a website. It's not like anyone is making a profit off his work.

Oh,and something I didn't see mentioned. It's not a violation of copyright to just use someone's image. It depends on how it's used. If it's used as a piece of a larger work, such as in a collage - no problem. I apprenticed under Warhol in the early 80's. If he didn't steal other people's images he would never have had a career as an artist. Think Campell's Soup or Coca-Cola. And the banana used on the first VU album? It came from a 50's era ashtray he picked up at a garage sale for ONE dollar.

As a professional photographer I can inform you, in the UK if you use someones image without permission then you are in breach/violation of copyright, I have personally sued people in the past and won.

I'd like to quote part of the post made by Admin "I can't understand why anyone, such as a photographer, would sue over his image being used for a boot cover or on a website. It's not like anyone is making a profit off his work."

That depends how you look at it, if someone is making a boot and selling it on and the artwork is the property of the someone else, then yes they are making a profit from the sales which includes the packaging, the same goes for any type of artwork.

People tend forget it's how we make our living, if someone wants the use of artwork/photos the correct route is to ask for a usage license.

My statement was made under the assumption that the bootlegs were simply being shared, as we do here. But, you're right. If it's being sold, that's in violation of the law. I was also speaking with US and international copyright law in mind. In the US I could use you're photo as a small but intrinsic part of a larger work, and that would be fine... though apparently not in the UK. Interesting.

Hi Ohio, I assume you suing somebody was when they tried to profit from your work?

I would be interested to know how people sharing here in a selfless (non profit) fashion are seen in your eyes? That is not meant in an aggressive way, I purely mean from a professional standpoint, how does it sit with you and how would it be a more beneficial process for all involved?

As an earlier post from me on this subject implies I will now be much more careful about using any photo I found in the web for cd covers.
At the end the question is : do we really need this? The answer might be no, but then you can also ask do we really need (illegal) live recordings.

I always try to contact photographers when I find their name or web address together with the photos I want to use. Exceptions might be people like Mick Rock where it seems to be useless to contact them and ask if it is possible to use their photo for a self-made cover. They might not even answer.

On the other hand you can find these photos from famous photographers sometimes in thousands in the web (and mostly without any indication of source) and I would use that photo just one time for my amateur attempt of a cd cover. And the point is, everything presented here is for absolutely non-commercial use.

And even if bootleggers use the recordings from this site here (which happens quite often I think) to sell them on Amazon or whatever they normally make new covers, maybe mainly to blur any trace of where the recording might have come from.
